Our store is hosted on Squarespace, Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

SECTION 13 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

Do NOT use the Artful Steel Wall Mount except as noted in the Product Instruction Video.
Attaching the Artful Steel Wall Mount to a wall, may damage the wall.
Dropping the Artful Steel Wall Mount may cause property damage, damage to the Artful Steel Wall Mount and/or cause injury.
Once the Artful Steel Wall Mount is attached to a wall, bumping into the Artful Steel Wall Mount may case property damage, damage to the Artful Steel Wall Mount, and/or cause injury.
Once the Artful Steel Wall Mount is attached to a wall, ONLY hang handpans with a center gu of less than 20 pounds (9.07 kilograms). For example, do NOT use the Artful Steel Wall Mount: as a hand hold to support a person; as a hanger for garments, such as, but not limited to, jackets; nor as an anchor to hold a pet leash; nor as an anchor to hold one or more bags.
Once the Artful Steel Wall Mount is attached to a wall, a hand pan hung upon the Artful Steel Wall Mount may fall off of the Artful Steel Wall Mount and cause damage to property and/or cause injury. Do NOT locate valuables below a hand pan hung upon the Artful Steel Wall Mount.
Limited Warranty
This LIMITED WARRANTY is for the original purchase of a Artful Steel Wall Mount and is between you, the original purchaser of the Artful Steel Wall Mount, and Artful Steel. Please read this information carefully as you agree to be bound by the terms listed herein by retaining ownership of the Artful Steel Wall Mount. If you do not agree to be bound by this LIMITED WARRANTY and DISCLAIMER of all other warranties, as noted below, you MUST return your Artful Steel Wall Mount to the merchant seller from whom you purchased your Artful Steel Wall Mount or to Artful Steel.
Your Artful Steel Wall Mount is warranted to be free of defects in materials and workmanship for a period of One Year from the original purchase date. If you discover any defects in materials or workmanship you are to return the Artful Steel Wall Mount to Artful Steel for refund or replacement – for the sole and exclusive remedy for breach of this limited warranty. You MUST contact Artful Steel prior to shipping for proper shipping instructions.
This LIMITED WARRANTY is VOID if you are using a modified Artful Steel Wall Mount, that has been modified in any way whatsoever. This LIMITED WARRANTY does NOT cover Artful Steel Wall Mount that are improperly used, abused, altered, repaired, modified or incorrectly installed.
Your agree this Limited Warranty is ONLY for normal usage of the Artful Steel Wall Mount as described in the Product Instruction Video.
You agree this Limited Warranty conferred by original purchase of the Artful Steel Wall Mount does not cover installation, nor removal, nor any damages that occur as a result thereof.
WARRANTY DISCLAIMER TO END USERS, Including Original Purchasers
Aside from the above noted LIMTED Warranty, Artful Steel, and their Directors, Officers, Employees, or Agents (hereinafter, collectively Artful Steel) make NO warranties, EXPRESS or IMPLIED, including and without limitation, the IMPLIED WARRANTY OF MERCHANTABILITY and the IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, regarding the use of Artful Steel Wall Mount in hanging hand pan musical instruments. Artful Steel does NOT warrant, guarantee, nor make any representations regarding using Artful Steel Wall Mount in hanging hand pan musical instruments. The entire risk as to the using Artful Steel Wall Mount in hanging hand pan musical instruments is assumed by you.
Note, the exclusion of implied warranties may not be permitted in some States of the United States and in some Canadian provinces and as such, the above exclusion of all implied warranties may not apply to you.
In no event will Artful Steel be liable to you for any damages whatsoever, including but not limited to, Consequential, Incidental, or Indirect Damages (including, but not limited to, damages for loss of business profits, business interruption, loss of business information, and the like) arising out of your use or inability to use the Artful Steel Wall Mount, or any damages arising from mounting, installing, removing, or owning the Artful Steel Wall Mount; and even if Artful Steel has been advised of the possibility of such damages.
However, note, some States in the United States and some Canadian provinces may not permit exclusion or limiting of liability for consequential or incidental damages, and thus the above limitations of such damages may not apply to you.
However, in any event Artful Steel liability to you for actual damages from ANY cause whatsoever, and regardless of the form of the action (whether in contract, tort, product liability, combinations thereof, or otherwise) will be limited to a purchase price refund (not including shipping costs) or Artful Steel Wall Mount replacement (not including shipping costs) AND up to $50 (US dollars) or less.
Disclaimer of Warranty of Title to Wholesalers, Distributors, and Retailers
Unless otherwise agreed to in a writing with a specific Wholesaler, Distributor, or Retailer, Artful Steel, and their Directors, Officers, Employees, or Agents (hereinafter, collectively Artful Steel) make NO warranties of title that goods sold by Artful Steel to any Wholesaler, Distributor, or Retailer will be free of infringement claims made by third parties. And as such, unless otherwise agreed to in a writing with a specific Wholesaler, Distributor, or Retailer, Artful Steel will NOT indemnify any Wholesaler, Distributor, or Retailer from a claim of infringement made by any such third parties.
SECTION 14 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Artful Steel and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
SECTION 15 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
